Abstract

The theories about administrative law conduct is an important part of theoratical system of administrative jurisprudence. The study on the components of administrative jurisprudence theory centres on administrative law conduct. Therefore, the study being made on administrative law conduct is of great importance to the set-up of administrative law system and specific practice of administrative enforcement of law as well.The classification to the administrative law conduct is not only the basis for constituting theoratical system of administrative jurisprudence, but also the key to studying the content of administrative law. As a result, the abuse in classifying administrative law conduct will definitely in fluence the building of theoratical system of Ad. LThrough the new classification of administrative jurisprudence conduct, that is through the study of compulsory administrative acts and democraticadministrative acts, this paper is to solve tow problems, On the one hard, it is to solve the problem existing in classifying the administrative jurisprudence conduct so as to enrich and perfect the theoratical system of administrative jurisprudence and enlarge its studying aiea to provide fresh thinking for theoretical study. On the other hand, the paper is to break the traditional idea that administrative jurisprudence conduct is equivaent to compulsory administrative conduct. It puts forward the new concept of democraic administrative conduct. It is to promote the democratization of government’ s behavioral ways, provide reliable basis for function transformation of government, urge administrative organ to adapt even better to the market economy as well as the executive command and the pracice of administrative trial under the comdition of market economy, and to increase the administrative efficiency of administrative body, to safeguard legal rights and interest of citizen, corporate body or other organizations.
