Abstract


It is an important move to enact the tendering and contract regulation of civil engineering for construction industiy to deepen the construction enterprise reform. Its appearance makes construction enterprise active in the process of reform. Being imperfection of management and law system, the best deal pattern, construction market has been hindered seriously. The situation becomes more seriously because the corrupt being present in the social has affected the construction tendering which should be a fair play and made the tendering and contract regulation useless. Nation and enterprise are subjected to losses. Through deep investigation and research, from theory to practice, the paper analyses the present condition of the tendering and contract regulation from the point of economics law, and affirms the advantage of this regulation. At first, this paper depicts the development and the significance of the tendering and contract regulation of civil engineering; it interprets the concept and the legal characteristic of it. In addition, it describes the basic rule of fulfilling the regulation and how to improve the practicability and manipulation of it. The paper introduces the other countries?successful experiences in executing the regulation, and raises the main existing problem. Finally, it points out how to consummate the legal thought and legislative suggestiom aiming at implementing further the tendering and contract regulation of CHiNA, establishing the healthful market system which is a uniform opening and fair competition market.
