Abstract


This paper uses a comparative analysis and case analysis of two research methods , highlights the legal system of the WTO dispute settlement procedures third party . Within the WTO system , as the complaining party , the WTO members other than the respondent party that the WTO dispute settlement body are processed in a dispute involving its interests , the members can resolve the understanding of the rules and procedures \interest in its handling of the case , to participate into the process of the trial of the case , this WTO members is \Back before the GATT / WTO , the concept of third party intervention in litigation in the areas of domestic and international judicial widespread - such as the \dispute settlement procedures third party \WTO dispute settlement consultation process , the panel procedure and appeal procedures for third-party provisions in practice there are still a number of legal issues need to be clear , the third-party system in particular, should pay attention to the coordination of the system itself and the developing countries special interest protection issues . China as a third party involved in the dispute settlement procedures of the WTO system more than 20 cases . China as a third-party participation in the WTO dispute settlement procedure , on the one hand, can show that their views and perspectives on some issues , and constantly influence and prestige within the WTO ; the other hand , can learn from the other members of the party complaint , the respondent experience . However, China should continue to expand as a third-party participation in the WTO dispute settlement practice , further positive exercise of the rights of third parties , actively invoke the provisions of the burden of proof in favor of third parties in the WTO documents in the Doha Round negotiations in the understanding of the rules and procedures for dispute settlement issues advocates the expansion of the rights of third parties , so as to better safeguard their own interests .
