Abstract


Cross-border transfer of pollution is the product of economic globalization , between developed and developing countries through trade and investment activities to achieve. Developed countries to use the urgency of developing psychological and economic development in the environmental cost disadvantage, export of hazardous wastes to developing countries continued , elimination of outdated equipment and products, and high pollution, high energy consumption enterprises , to transfer pollution consequences and environmental management responsibilities purposes. Although cross-border transfer of pollution to reduce the transfer side pressure on the domestic environment , access to huge profits , but the transferee domestic environment is destroyed, consume large amounts of natural resources , endangering the health of local people , but will also undermine the economic development potential of the transferee , the transferee parties have a profound impact on Sustainable Development . Therefore, how to prevent cross-border transfer of pollution has become a common concern of many developing countries , has become China's urgent environmental problems. Remove introduction and conclusion , this paper is divided into four chapters: Chapter I outlines the concept of cross-border transfer of pollution and the basic types , through cross-border transfer of pollution defined comparison analysis, the cross-border transfer of pollution of the four elements . Meanwhile, the analysis of the developed countries, the implementation of cross-border transfer of pollution to China 's three main ways and cross-border transfer of pollution on the environment, our national security implications . The second chapter focuses on analysis of the cross-border transfer of pollution liability regime , through the analysis of national responsibility and corporate social responsibility, cross-border pollution proposed transfer of State Liability under the principle of strict liability should be taken , and that cross-border transfer of pollution to be borne by the state and enterprises form of liability . The third chapter analyzes the transnational transfer of pollution control related international legislation , WTO environmental exceptions to the right and the United States and the European Union on cross-border transfer of pollution control domestic law . Chapter IV of the relevant legal system, combing through , summed up China's current legal system control of transnational pollution transfer limitations , recommended the adoption of the Basic Law and improve our environmental management legislation related investment projects to improve environmental standards and build our tax system and other means domestic environment further Improvement of cross-border transfer of pollution control legal system .
