Abstract


With the development of the times, service trade has become the important content of the international trade. Education service trade, as a branch of service trade, is booming on the stage of international trade. In GATS which was singed in 1993, the education service trade also is an important component. For the education service trade in our country starts a little late with the incomplete education service trade system and law system, the education service trade in our country is influenced and it is unbeneficial for the formation and development of our education service trade system.This paper deeply analyzes the law system of the education service trade in our country. Through the research of the current education service trade law system and the contrast with the advanced law system of the foreign countries, the paper points out the disadvantages of our education service law system and gives some suggestions on perfecting our law system.Chapter one introduces the research goal and method of the paper, and summarizes the interrelated researches at home and abroad, so that to find the points of this paper.Chapter two analyzes the education service trade generally. Firstly, the paper introduces the definition of service trade and points out the features of service trade. Then, the paper analyzes the history and supply patterns of education service trade. Finally, the paper analyzes the necessity of law regulation on education service trade.Chapter three analyzes the tied mechanism to education service trade in GATS, summarizes the basic principles of education service trade in GATS, and analyzes the concession mechanism in GATS including the horizontal commitments and specific commitments. Finally, the paper evaluates the tied mechanism and points out its shortness.Chapter four analyzes the education service trade in our country. Firstly, the paper analyzes the current situation and our commitments of the four types of the education service trade. Secondly, the paper analyzes the current law system of the education service trade. Finally, the paper points out the defects of the law system.Chapter five analyzes the law system of the foreign countries which are advanced in education service trade including USA, Australia and England. The paper analyzes the current situation and law system of these countries so that to evaluate their law system and conclude the advantages as the suggestions to perfecting our education service trade law system.The last part of this paper gives some suggestions to perfecting the law system of our education service trade. Firstly, perfect our national law. Secondly, strengthen the cooperation with other countries to avoid education service trade barrier. Thirdly, establish education service trade oversight mechanism.
