Abstract


Question a witness rule is a key part of the rules of evidence in the Criminal asked witnesses to obtain testimony , identify the basis of the case . Common Law Department of the national legislative , judicial and jurisprudence research has been on and ask the witness -related issues to be concerned about , makes the judges of witness testimony admissible to establish in strict inquired program directly through the main inquiry ( asking ) with anti- inquiry ( cross- inquiry ) rules , the basis , to form a more perfect rules of the questioning of witnesses ; relatively speaking , China's long-term existence of the traditional \the necessary attention to the admissibility of evidence less restrictions , criminal asked witness rule failed system set up , there have been various problems in the judicial practice . I believe that the deal with Britain, the United States and other countries , asked the anti reasonable inquiry rules draw clear , the operability strong questioning of witnesses rules established by law in China . The paper is divided into an introduction, body , conclusion of three parts , the body of Chapter clear witnesses and witnesses with the concept of the rule , the second chapter of the common law master asked with anti inquiry rules were introduced , Chapter III , Chapter IV ideas , such as establishing the existing law on the examination of witnesses in China , the existing problems and the establishment of the need to question a witness rule described , the fifth chapter is the author of the Perfection of questioning witnesses rules shall not question one's own witness , against leading questions and other rules , the established opinions rules and asked the witness rule , the hearsay rule and other rules of evidence . Rational core, the introduction of Anglo-American law to question a witness rule to establish the rules of the questioning of witnesses suited to China's national conditions , and contribute to a more fair trial procedures , help improve our country 's criminal procedure system is conducive to the realization of judicial justice .
