Abstract


In the vigorous development of electronic technology , computer network crime , e-commerce disputes and e-government disputes continue to emerge , making the electronic evidence of the growing importance of electronic evidence, has developed into a new forms of evidence beyond the traditional . The era of electronic evidence is all evidence of traditional electronic era . In this paper , on the basis of the basic theory in the study of electronic evidence , the use of electronic evidence and legislative issues in-depth and systematic research . The text includes an introduction , body and conclusion of five thousand words . The text is divided into three chapters . Introduction by a brief description of the extensive penetration of a variety of electronic information in the legal life , leads the research for solving computer crime , electronic commerce disputes , e-government disputes and protect the healthy and rapid development of e-commerce . The first chapter is the basic theory of electronic evidence . Concept, characteristics and classification based on the interpretation of electronic evidence and comment on all kinds of theories about the legal status of the electronic evidence , advocated an independent evidence of electronic evidence . Finally, this chapter focuses on the evidence of the ability of the electronic evidence and probative force . The second chapter is the use of electronic evidence . The introduced special electronic evidence forensics main of the rules of procedure for the search and seizure of electronic evidence , focusing on a review to determine the content and method of electronic evidence . Chapter legislation for electronic evidence . A comparative study of electronic evidence, the legislation of the world's major countries and international organizations to learn from the legislative system and content of electronic evidence Commentary and analysis of electronic evidence, lack of law , made ??a number of sound advice . The concluding part of the ideas and content of the full text collate and summarize .
