Abstract


Securities Investment Funds Trust is a popular investment instrument. Investment Fund of scale, diversification of products and services, strong market penetration and influence have had a positive impact to our society and economy. The development of global economic integration and liberalization has made investment fund products and business across national boundaries. Investment fund has become a globally important investment tools.Since 1991, securities investment fund business has got virtual progress in China. Relative to the rapid developments of its’ own fund, the prevention and control of risks are backward. In the development process of the Fund, there are a lot of problems and risks, such as "black funds"、"Rat", and other issues of interest transportation. The problems and risks have blocked the development of fund industry. China’ Fund is used contractual forms of organization, fund management companies control and operate the Fund with little restriction or no binding, it is detrimental to the interests of fund holders, increase investment risk, and is not conducive to long-term development of the fund industry in China. Investment management services are the cores of fund management companies, the investors are think of that integrity of fund management companies and investment management capabilities. To respect and protect the interests of investors is the key to the sustained and healthy development of Fund industry. Safeguard the interests of fund holders is the core to the survival and development of Fund. Protecting the interests of the Fund need to prevent and control risks.This article has a more comprehensive and in-depth analysis on the major risks, and put forward the construction of proposed system on the conclusion of the study for analysis. The full text is divided into four parts: the first part, introduced the basic securities investment funds, including the Fund’s definition, characteristics, classification, development and the status of financial system; the second part of the risk of securities investment funds in detail discussed briefly the meaning of the risk of the fund, according to different standards of risk to the Fund are classified, and the risk of the causes of the Fund have been outlined; The third part is the focus of this article, the main risk to the Fund on the legal regulation. China’s fund from the existing legal regulatory risk and its defects to write, the Fund introduced the developed countries to control the risk of legal initiatives and inspiration for us, but also focus on assessment of the "black funds", "Rat" illegal cases, in this section, finally, to guard against the risk of the fund to build the legal system. System to build the three aspects of writing and improve the fund management structure and improve the fund management company’s management structure and improve the regulatory regime of the Fund; Part IV, in view of "Securities Investment Fund Law" part of the contents is no longer suited to the actual development, the writer put forward legislative proposals in order to better protect the interests of investors.
