Abstract


The soul of criminal legislation and criminal justice is criminal policy, and the criminal policy not only has long historical and cultural origins, but also after has a long historical process. From the Confucius to today the Criminal Policy of the temper justice with mercy changes through centuries of history, which eventually became the chief principle of our criminal law. The criminal policy of justice with mercy has always insisted on the criminal distinction, it is necessary to effectively combat crime and safeguard the seriousness of the legal system, while minimizing the social confrontation, and turn negative factors into positive one, legal and social effects to achieve unity. Especially in the context of building a socialist harmonious society, the implementation of the criminal policy of temper justice with mercy is even more important. Therefore, our current emphasis on the implementation of criminal policy temper justice with mercy, not only for new developments in criminal policy in China, but also insist on people-oriented, full protection of human rights, improve the criminal legal system embodies.This article will introduce the criminal policy profiles and explaining the implementation of its policies,and the need to explore the key policy how to make our temper justice with mercy criminal policy, in order to apply to criminal justice activities better, in order to speed up the construction of China’s criminal law, promote harmonious social development, respect and protect human rights and punish crimes.
