Abstract


Favoritism as a serious crime of crimes committed, the subject of crime has greatly particularity, prosecution capricious and arbitrary implementation of bending the law , tend to intensify social contradictions .Not conducive to social stability and development. It undermines the normal legal order, violated the legal rights of others, and tarnished the masses of the people in the law in the glorious image. Detrimental to the national authorities and the national staff of the good image, reduced masses of the people’s trust in state institutions. As the social complexity and particularity of the subject of crime, there are many disputes on understanding of the crime,result in judicial practice, many difficulties encountered. In this paper, the analysis of the crime of research using historical, empirical, and the comparative method, in order to be able to present a comprehensive understanding of the crime, hoping to have some help on the judicial practice . In this paper, including four aspect. The first part discusses the historical evolution and the crime of bending the law the legislation on foreign. The second part focuses on the crime of crime, mainly composed of four elements from the crime to start. The third part of this article described the crime in the judicial practice of favoritism in the judicial determination problem, issues of judicial practice on some preliminary discussion. Last part of the main reasons for favoritism crime incidence in the prevention mechanism put forward some constructive solutions to China’s judicial work can improve the quality of help.
