Abstract


Administrative rulings and judicial trial parallel operation is one of the characteristics of patent protection . However, for the provision of administrative protection of patent rights is a common practice in most countries . Over the years , the theoretical and practical circles administrative protection of patent discussed more, but there are some specious argument is always popular . I try to Discriminate on some issues . This article describes the patent content, nature protection and tort liability , combined with the practice of the world discussed the administrative protection of a variety of ways , focuses on the general characteristics of patent protection , analysis of patent protection in some hot problem, a comprehensive proposal of patent protection .
