Abstract

Bank is funding media -based, for-profit legal person . As the increasing development of direct financing coupled Mixed increasingly becoming the trend of financial sector development , foreign traditional banking business is facing deposit and loan spreads narrowed, with banks and unusual competition increasingly fierce grim situation , the banks have closed down due to poor management of the phenomenon in the inevitable . And poor management of bank failures , to improve the overall management capacity of the banking sector , strengthening the competitiveness of the banking sector also has a positive effect. But banks are also lending and Zijin Zijin transfer hub in promoting economic development and maintaining social funds payment and settlement , and even maintaining social stability has a very important role. Therefore, foreign governments and financial regulators on bank failures are taking a very cautious approach. Based on the analysis of bank failures relative to the general industrial and commercial enterprises bankrupt difference as the focus , through commercial banks in China and other countries with Anglo-American legal system of bank failures comparative analysis on how to improve the legal system of China's commercial banks bankrupt some of the views put forward their own .
