Abstract


Safeguards are vital to the terms of an exception to the WTO rules , also called Disclaimer , use of the principle of change of circumstances \The measure means that when the rapid growth of imports on the domestic industry of the importing country resulting in serious injury or threat of serious injury , the governments of importing countries to take an import restrictions . Safeguards mechanism in the WTO multilateral trading system lies in the delineation of the boundaries of members to undertake reduction commitments , to coordinate the various members and long-term interests of some members of the immediate contradictions and conflicts , to maintain the stability of the multilateral trading system . Safeguards damage to the interests of the balance of trade as a relief industry an important trade policy instruments , and its role has received increasing attention of the WTO members . China 's accession to the WTO , on the one hand means more fair trade environment , trade opportunities gradually expanded , which makes many of the traditional competitive advantage to encounter other WTO members frequent safeguard investigation may increase ; On the other hand , China's still the lack of international competitiveness , many industries face the impact of foreign products , we need to use legal means of safeguards to protect the damaged industry . Thus, the WTO safeguard rules and safeguards in China major strategic importance . In this thesis, the historical evolution from the safeguards to start, theoretically first overview safeguards the principle of operation and the effects of the measures , fully elaborated framework of the WTO and China safeguard rules , combined with international disputes Settlement Body ruled certain cases , to explain his own point of view on controversial issues , then linked to specific trade environment and the state of the industry ,
