Abstract


Safeguards known as a \Reached the end of the Uruguay Round negotiations, the safeguards agreement, so that a relatively complete system of safeguards to be established in the WTO. The system from a formal point of view, free trade regime to the contrary, its purpose is to make the treaty obligations assumed by the Parties with a certain degree of flexibility, so that the Parties waive its obligations commitments or agreements in exceptional circumstances predetermined behavior. Its role of States to protect specific industries and economic security can not be ignored. In addition, the existence of the special safeguard measures in specific areas, such as the special safeguard measures on agricultural products, emergency safeguard measures on textiles transitional safeguard measures and trade in services. China's accession to the WTO legal documents - \Different types of safeguards there are significant differences in terms of the applicable conditions applicable object and applicable deadlines., It is necessary to compare. This paper attempts a comparative study of the safeguards regime of the WTO system targets, applicable conditions and applicable deadlines, specific cases that the major hazards of the special safeguard measures unfair and, at the same time make appropriate legislative proposals coping strategies and practice. Text consists of three parts: the first part, by listing the type and name of safeguard measures within the WTO system, a review of the historical background of the various safeguards, specifically addressed the safeguards, special areas of protection measures and special safeguard measures and the \concept characteristics, to do macro introduce safeguards in the WTO system. Second part, on the basis of macro understanding of safeguards, elaborated on the contents of the various security measures and targets, applicable conditions, retaliation and compensation comparison; WTO members on the implementation of safeguards in China through specific data measures and special safeguard measures and the WTO Dispute Settlement Body accepted safeguards disputes, further analysis of the difference of the safeguard measures and special safeguard measures and special safeguard provisions of significant harm to China with the typical cases. The third part, the positive and negative impacts on our analysis of a variety of safeguards, that our real problem in the field of safeguards and legislative issues and put forward the corresponding countermeasures and suggestions to solve the problem.
