Abstract


Accession to the WTO over the past three years , China's foreign trade continued rapid growth , to create the world Jiaokou envy of so-called \However , China also faces the same time enjoy the \Will face more obstacles to implementation of the special safeguard measures against Chinese exports of China \Feasible suggestions for a correct understanding of the special safeguard measures against China's impact on China , and provide comprehensive, systematic research in this article from the legal perspective on the major issues involved in for special safeguards , these problems are : source of special safeguard measures ; relatively general sense safeguards it what characteristics ; mainly members of the WTO on the special safeguard measures which legislation ; practice how to invoke the special safeguard measures , WTO members ; exist in the application of the special safeguard measures what issues ; special safeguard measures against China , what impact , what counter-measures . The use of the provisions of this article , case studies and historical analysis , the study divided into five chapters on the above issues . The first chapter introduces safeguards the history , the rules of the WTO safeguards system ; second chapter analyzes the source of the special safeguard measures as safeguards exception , the basic system and characteristics of the special safeguard measures against China ; third chapter describes China major trading partners , the special safeguard measures against China, legislation , and be on the legislative situation analysis ; Chapter investigation WTO members to analyze the reasons for WTO members to implement special security measures for China resorted to special safeguard measures , whether the final implementation of the special safeguard measures factor. The fifth chapter discusses the issues and make the author's point of view on the special safeguard measures applicable ; Chapter VI of the impact of an objective analysis of the special safeguard measures on China and to propose a solution .
