Abstract


With the development of China's socialist market economy , the enterprise as a funding body , its financing needs of the growing expansion creation of consortia mortgage system is the trend of the times . This paper tries to comparative law , philosophy of law , economic analysis and trade-offs , from the width, height and depth of the three - dimensional perspective , the consortium secured legislative situation , the consortium mortgage legislative value , financial mortgage legislation technical problems, financial mortgage important issues such as the content of legislation designed to be analytical discussion . Consortium secured legislation can not be achieved overnight , should not be in advance , can only be gradual , according to the special circumstances of certain sectors , really value because of the economic needs before considering the provisions of the legislation on the best use of Japan legislative mode , that is to be provided by industry to establish and separate regulations . Our financial mortgage legislation should include the five aspects of the scope of application, the composition of the consortium , the consortium mortgage contract , the publicity and dispose of financial mortgage restrictions .
