Abstract


Of geographical indications and its related concepts distinguish , define, and refers to the definition of the International Convention on the TRIPS agreement , different countries taken different modes of legal protection of geographical indications and characteristics of the domestic and international legislation , international similar provisions in the treaty conducted in-depth comparison and analysis . This article explores the legal basis for the protection of geographical indications and administrative procedures in a reasonable and weaknesses of current trademark legislation and the protection of specific legislation on geographical origin of products mixed forms of protection characteristics and the presence of the issue also carried out a detailed statement . On the basis of the analysis of the current situation and problems of the legal protection of geographical indications to explore ways to effectively solve the existing problems . In this paper, the recommendations of the Geographical Indications protection for the Chinese situation in some conflict of laws and statute conflict . Finally, it proposes should be used to the \protection, and an active advocate in international negotiations to expand the scope of protection of geographical indications is the most effective way to resolve the existing problems .
