Currently, China’s situation of energy saving and emission reduction remains grave, various problems and contradictions abound. Many countries use government command and control methods, and measures of economic incentives in energy saving and emission reduction work in the world. Public participation in energy conservation is the right of the public to participate in energy conservation decision-making, access to energy conservation-related environmental information, monitoring the behavior of government, enterprises, units and individuals, and when the right to information, participation and supervision are not protected, the public should be entitled to relief by law. Learn from foreign experience and practice of our country, the building of public participation mechanism is from administrative, economic and legal means, all three works together but there are different focuses.Administrative measures include quality standard, emission standards, environmental label system, environmental impact assessment system, ect. Because the public worship the government authority, in promoting public participation, the administrative measures are more advantage than abroad. Economic instruments are more flexible than administrative measures, because the interests of stimulating are more prone to radical change human behavior. Developed countries in the promotion of public participation use tax concessions, financial subsidies, mortgages, and other means of mitigation funds, combined with various means, received a good energy saving effect. But our current economic instruments in promoting public participation still exist many problems, lack of enough means, the scope of regulation is narrow, control of dynamics, and there is less concerned about the behavior of company and families, and individuals’ reduction, economic instruments can not play well of its’role. Public participation in the legal protection is the most effective protection. Watch China’s current legislative system, legislation on energy saving and on public participation is pitiful, there is an urgent need for the law on public participation procedures, approaches, content and scope of the public right to access to justice detailed and specific operational requirements, we should protect the public participation in energy saving from the legislative and judicial views.
