Abstract


Of 1997 to develop a new Penal Code section 385 , section 388 clearly defines how convicted and punished for taking bribes . But in theory and judicial practice, on the objective aspect of crime of accepting bribes in the \range of personnel , a number of issues of common crime, there is still considerable controversy . This paper focuses on the objective aspect of the crime of bribery and crime that exist in the body of the contentious issues , are discussed and put forward their own views . From the analysis of the existing provisions of the law starting to clearly define the connotation of the concept , draw the scope thereof , and thus from a legal point of view Ought lack of legislation to find loopholes in the law , proposed to be the perfect method . Through elaborate on a number of contentious issues , help in theory and judicial practice to draw the boundaries of crime or to accurately identify bribes .
