Abstract


A series of serious mine environmental problems and the sudden worsening of the mine soil environment are because of the recent large-scale exploitation, and already have serious influence to social development and people’s health standard. At present, China’s environmental governance legislation on mines scattered, management systems are chaotic, lack of coordination and lack of the legal system with operable to carry out mining environmental governance. In this case, this paper proposes the establishment of a sound legal system of mining environmental management system to actively and effectively carry out the work of mining environmental governance to curb further deterioration of the mine environment to achieve the sustainable development of the population, resources and environment.The first part of the paper, starting from the meaning of the mine environment, direct exploitation of mineral resources in China is currently a result of a variety of environmental problems, demonstrates the necessity and urgency of the management of mine environment. Meanwhile, the analysis of the mine environmental management functions of the legal system, and described the mine environmental governance, the theoretical basis for the legal system.The second part of the paper summed up the current mining environment of China’s legal system, the legislative status of governance and management of the status quo and analyzes their shortcomings, so as to further provide a basis for comparative analysis. The third part of the paper, through a comparative study of the methodology, introduce the legal system of the United States, Australia, and other mineral mining environmental governance in developed countries, analyze their characteristics and advantages mainly from the administrative management system and relevant laws and institutional. Through the analysis of advantages and disadvantages of national systems, to learn the advanced experience, avoid duplication of its tortuous path traversed by.The last part of the paper, in the above analysis, the basis of comparison, this article on the legal system of environmental governance in China mine made a series of sound proposals, in the analysis of the existing mine environmental impact assessment system, land reclamation systems, mine environmental management system defects such as is proposed based on a sound recommendations; for the environmental permit system has not been established, mining environmental management deposit system is proposed to build vision. In the interest of institutional design, perfect at the same time, more emphasis on the system implementation process operability. It is noteworthy that in this paper, mining environmental governance in China’s legal system should be designed to develop and produce mineral resources throughout the entire process of point of view, from project planning system phase of the mining environment, the mining environmental impact assessment systems, the mining environmental permit system, to the competent departments of environmental protection performance the supervision and inspection system, to the mine after the mine finished land reclamation and restoration of the system elements of the surrounding environment.
