Abstract


Since the implementation of the State Compensation Law of the People 's Republic of China \State Compensation Law of the People 's Republic of China \system in practice gradually revealed the problems and shortcomings : the principle of attribution of criminal compensation provisions is not clear , the narrow scope of criminal compensation , Non Prosecution of criminal the compensation law enforcement does not unified , criminal confirm system flawed , these are urgent required to improve and solve the problem . Therefore , improve the national criminal compensation system should focus on four aspects , namely a clear imputation of criminal compensation principle , the expansion of the scope of the criminal compensation , compensation specified Non Prosecution case improve the criminal confirm system . Learn from Taiwan, China and foreign legislation based on the combination of China's actual situation , the response to these four questions , put forward suggestions for improvement .
