Abstract


Throughout the history of the ancient Chinese , the contractual relationship is always bound , subject to a variety of factors , not the development of freedom . Combined with a closed agricultural economic constraints , making the contract has never been dominant in the social life of the ancient Chinese , to the contrary, the contract shall be subordinate to the interests of the authoritarian regime and family interests , personal interests are seriously neglected . Currently, academic research , or based on the ancient Chinese contract system overall in the whole expedition , or specialized research dating method using longitudinal comparison study ancient Chinese contract system treatise rare , ancient Chinese contract system for certain types of specific contract seldom specialized research . In the longitudinal comparison , the empirical analysis on the basis of this article , by studying the sale and purchase contracts of several major Chinese Western Zhou , Qin and Han , Sui, Tang, Song and Yuan , Ming and Qing historical period , trying to reveal ancient Chinese trading contract value to China the methodology and study of ancient contract system of direction or purpose on the breakthrough . Vigorously promote socialist economic reform in our country today , it is necessary to establish a new , fully adapt to the current contract system of the market economy , not only need to learn from foreign experience in contract law developed economies also need to understand the development of understanding of contract law history , the new contract system and our original contract basis organically combine to make it a new impetus to promote economic and social development .
