Abstract


The administrative contract, which not only make public authorities develop their administrative ability much effectively and guarantee the realization of administrative goal, but also as possibly as make subjective side take part into social actions for public interests positively and constructively, protect their legal rights and interests effectively. Based on realization of public goal for society, the formulation of substantial rights and duties of administrative contract should emphasize on the privileges of administrative authorities , so it leads unequal rights and duties relationship between involvers.In order to control the abuse of contract privilege of administrative authorities, equal contract interests between involvers, systems of procedure should be formulated to control the contract conclusion, fulfillment of administrative contract, the supervision and management of administrative contract; at the same time, provide the complaint and selection rights for subjective sides, build up systems of administrative determination, arbitration, reconsideration and litigation which are mainly means to remedy administrative contract.Chapter one analyses the definition, effects and categories of administrative contract, which provides the foundation for substantial systems formulation in back.The author analyses the right and duty relationship between contract involvers, and point out that the formulation of right
