Abstract


In the real life of our country, the accidents that unlawful administrative behaviors violate lawful rights and interests often take place. The one that contrasted sharply with it is, but the construction of the system of administrative legal liability of our country and study on system of administrative legal liability of the academia are both weak. The construction of the system of administrative legal liability should occupy an important part in the administrative legal system of one country, because it is the important guarantee of building a country governed according to law and administering the state according to law. The ignorance on theory and the imperfection in legislation lead to our lagging behind administrative supervision, which have influenced the process governed by law of administration further and seriously. Administrative practice of legal liability issue quite outstanding, administrative theory of legal liability discuss rather rare. We can say the administrative legal liability question is a significant question with great theory and practice meaning. Investigating the current research situation of the administrative legal liability of our country, scholars have various opinions on the concept and connotation to administrative legal liability, the wise see intelligently. This text regards basic theory of administrative legal liability as the starting point, adopts the method that the theory combines with practice, examines the defect existing in the practice of system of administrative legal liability of our country, probes into several theoretical questions of structuring the system of administrative legal liability of our country.
