Abstract

Non-compete contracts to protect the enterprise business secrets from infringement plays an important role. however, some enterprise abuse non-compete contacts, let laborer undertake this should not be liable for non-compete obligations, and any non-compete contracts expend assume the obligation of main body, cause all enterprise employees with enterprise in signing non-compete contracts phenomenon, a serious violation of the rights of employees.This article through to the domestic several typical case analysis, leads the introduction, non-compete contracts and through the domestic and international non-compete contracts of comparative analysis, must be made to our country non-compete contracts legal regulation, mainly including the non-compete contracts concluded by the compulsory subject, to protect the interests of the species, competition restriction, professional term, regional scope, economic compensation, liabilities and disclaimer reason, to make up for the deficiency of the existing laws and regulations, seeking business secret protection and laborer free right of choosing a balance of interest.
