Abstract


Along with the development of the modern science and technology, the construction of the digital library has become an important marking to evaluate a nation’s information basis level at present, is also the foundation item that the developed nations think highly recently. It’s the request of the digital ages to carry on the digitized treatment to the books and reference materials with the digital technique, and to carry on the management of the library in the modern means, so as to make full use of the library to disseminate culture, to supply the people with high-quality service ,and to offer more educational opportunities. The construction of the digital library is of great urgent, but there are many copyright problems which need to be resolved in the actual operation process.If the national digital library digitizes many kinds of works that others have the copyright and dissemination them on the net, Is it necessity to obtain the permission of copyright owners? And to restrict the rights of the copyright owners? Can we apply to apply" fair use" 、 " statutory license" and" admit compulsory" principles as to the traditional library? If these problems can’t be resolved, and all the works must be spread on the net with the permission of the copyright owner, the digital library can’t be built and run smoothly, and it’s function can’t be given full play; but emphasizing the public welfare and urgencies of the digital library construction persistently whole ingnoring the right of the copyright owners will just bring numerous copyright infringement disputes. Exactly in view the important of the digital library in digital ages and of the copyright problems to the digital library development. The full text includes 3 parts introduction and conclusions.The Part of introduction contains the cause and purpose of the article as well as the author’s train of thought in writing the article.The first part- The summarize of the digital library. At first, the author introduces the notion of the digital library. The propose of these part, the author emphasis to illustrate the nature of the digital library. In the end we draw the conclusion that the digital library is a limited-library company, and operation in commercial, so it can’t play on equal footing with traditional library.The second part—the research condition and research significance of the copyright problems. In this part, the author introduces the research condition of many countries ,including our country, then draw a conclusion that we have make a great progress , but the road we have to walk is very long. So I wish more and more experts and authors can join into our group, because it is very important and significance to our digital library.The third part—the author introduce the problem during the construction of the digital library .the tale of copyright has been linked inextricably to the development of technologies for creating and distributing the fruits of intellectual creativity. Again and again, technological between authors and their raw material and between copyright owners and users of copyright works. These change have engendered repeated struggles to find the proper balance between the rights of copyright owners and the rights and privileges of members of the public to use and transform those work.The forth part- the author mentions four ways to resolves the problem of the digital library. First of all, to strength the ligistation, especially is to modify the copyright law. Secondly, to perfect and collection management system of the development copyright to resolves the authorization permission problem. Thirdly, to establish an new scope for the "fair use " and so on. Today, the pace of technological innovation is relentless ,and the copyright balance act has become correspondingly more difficult. Determining how copyright law should respond to the challenges pose by digital technologies and communications networks is a pressing, and controversial task. Efforts to address these challenges, moreover, are increasing global in nature.The part of conclusion reviews the problems of the article and looks forward to the future of the development of the digital library. Although there exist many problems in the early stage of the modem library, it’s an irriesistible trend to built the digital library .Through using the experience other countries for reference ,though the inquiry of the lawgivers and scholars ,and the practice of some digital libraries, all the trials are encouraging and the future of the modem library is bright.
