Abstract


Under the condition of modern market economy, business secret is secret weapon by which market participator overcome company,whoever own one term or several term business secret and equitably use, he can possess predominance in drastic market competition.Business secret may give competitor fetch huge loss once it is lost or theft.Because business secret possesses so huge value, supply self-contained legal protection for it,may attend and promote health development of market economy.Since 20th-century , many states have established law system about business secret protection,some international convention also found cosmopolitan business secret protectorate, business secret protection has rolled into one important law branch,the law system of business secret steps later in our country,it is of momentous operation significance to strengthen theoretical investigation and perfect business secret legal protection.This text expounds several controversial issues about business secret legal protection, hoping to exert a little for legislation perfection for legislation of business secret protectorate in our country in future .The first part reviews some basic problems about business secret.Firstly,it defines the notion of business secret.On the foundation of proceeding contrastive analysis to relative definition abroad,it thinks language formulation is different in allied nations,but defining the notion of business secret from the following aspects is the same ,for example, fresh gender, secret gender, value gender, concreteness, possessor adopt cryptosecurity.Then,it analyses
