Abstract


Government-owned information resources is the important resource of the era of knowledge economy, citizens and organizations to participate in state management, and to safeguard their rights, and promote economic and social progress of the indispensable conditions. To make these resources can really play a role to improve the level of allocation of social resources and the government's work performance, we must vigorously promote government openness and sharing of information. Establish a government information disclosure system, the disclosure of government information can be institutionalized, standardized and long-lasting, and ensure that every citizen and organization to maximize the use of government information resources to ensure effective government institutions, fair, transparent duties to protect the legitimate rights and interests of citizens, legal persons and other social organizations. The Charter of the United Nations, the Convention of the Organization of American States Human Rights and the European Convention on Human Rights and so provides for freedom of information, stressed that the rights of individuals and organizations to obtain information, and there are many countries in order to the Constitution form or the form of a special law to confirm the rights of the citizens' access to government information. In the 1990s, the government information public to enter a new stage of development, the traditional government a new look for a new kind of government information management mode. After the reform and opening up, China will also open government information as a guarantee citizens the democratic management of national oversight and important way to protect their own interests, and the importance to be regulated by individual provisions of the laws and regulations in the form of some cities also have carried out fruitful practice and exploration. Compared with Western countries, China's government information disclosure system there are still a large gap, especially with regard to the basic philosophy, operating procedures, and relief mechanism, due to the differences between the different national conditions, political and cultural habits, and foreign government information disclosure the scope and manner of the arrangements for the protection of privacy and secret remedies and so there are different approaches to information disclosure in some countries experience we can learn from studying. By comparison, the same point of the foreign government information disclosure system are: (1) they have a complete set or series of public legislation; (2) has a public information request rights provisions; (3) has a clear implementing organ; (4) has provisions on information disclosure exclusions; (5) has a specific supporting the implementation of measures; (6) have complete relief channels. China and foreign government information disclosure system different points: (1) the constitutional basis; (2) law; (3) open content; (4) exempt from the open range; (5) open in different ways; (6) open procedures; (7) public relief.
