Abstract


Came into effect on May 1, 2004 , the People's Republic of China on Road Traffic Safety Law \satisfactory. In order to regulate the behavior of the motor vehicle registration in China , in particular, a clear motor vehicle registration authorities in the motor vehicle in terms of responsibility , we redefine the concept of the motor vehicle registration , that it is the motor vehicle registration department in accordance with the application of the citizens, legal persons or other organizations , the sum of the ex ante regulation in accordance with the law on the vehicle on the road , providing the public service system . The paper points out the one-sidedness of the current theoretical and practical circles know the nature of the motor vehicle registration . The authors believe that the registration of motor vehicles has a dual property , both Chief Executive confirmed that the motor vehicle of property rights is also a vehicle on the road of administrative licensing . The paper is divided into four parts. The first part is a general theory of the motor vehicle registration , starting from the definition of motor vehicle registration , and analysis of the concept , characteristics and properties , clearly recognized the dual nature of the administrative licensing and administrative . The second part is to sort out the historical development and current status of China 's motor vehicle registration , through the analysis of the status of the research and implementation of the historical evolution of China 's motor vehicle registration , and certainly China 's motor vehicle registration system in the administration according to law and has made ??considerable progress . The third part of the problems that exist in the current motor vehicle registration system , and analyzes the main reason is : the government the absence of the concept of law-abiding , responsible government , the only , the only right thinking proliferation of disregard for the legitimate rights and interests of citizens and departments , local interests drive , resulting in reality there are still incompatible with the requirements of the country of the rule of law practice . Section IV presents shall legislate and to implement countermeasures . Empirical analysis , combined with the provisions of the Administrative Licensing Law of the People 's Republic of China to resolve China 's motor vehicle registration system in the legislation and implementation of the six questions , and puts forward the improvement of legislation to correct illegal detailed responsibilities , a sound system and other appropriate countermeasures.
