Abstract

Embezzlement sin is state personnel use the convenience of position of the implementation of a crime, it is one of the most important embezzlement charges, practice high incidence. Due to the independence of misappropriating public funds into sin time is not too long, and criminal legislation and judicial interpretation of the provisions of this crime and after several changes, with the development of society, the crime of misappropriating public funds law defect is day by day prominent, making it a hazard behavior in understanding and processing produce many differences. Although our country criminal law educational world the widely discussed, but there are still many problems remain to be solved. Therefore, it is necessary to strengthen the study of embezzlement crime in the judicial practice, in order to identify and correct the crime shall be punished. This paper tries to according to the ancient and modern, Chinese and foreign relevant embezzlement crime legislation and judicial practice, this paper, from the crime, crime form and the identification of nature of the crime of embezzlement, sin a system, depth, and on this basis puts forward some perfect the criminal legislation ".
