Abstract


North American Free Trade Agreement (NAFTA) as the United States, Canada , Mexico, the three countries signed a regional trade and investment treaties , which reached the depth and breadth of investment rules , until now, none of the investment rules of the multilateral or regional treaties can match. Chapter 11, section B established investors - the host country investment dispute settlement mechanism, in multilateral legislative efforts of the international investment , has important milestone in the development of international economic dispute settlement mechanism , it is NAFTA creative a contribution . This mechanism also has major implications for investment dispute settlement mechanism in the future the world treaty . Combined with actual case of NAFTA , and ISCID , ECT , MAI draft provisions of other international instruments , in accordance with the provisions of Section B of Chapter 11 of the NAFTA , try to NAFTA Chapter 11 dispute settlement mechanism analysis and commentary . In addition to the introductory part is divided into three chapters. The first chapter introduces the basic content of the NAFTA Chapter 11 dispute settlement mechanism , including its scope of application as well as its rules of procedure . The second chapter analyzes the ground-breaking and controversial legal system or the legal issues in the NAFTA Chapter 11 dispute settlement mechanism . Including : the mechanism of the parties \The third chapter studies the influence and inspiration of the NAFTA Chapter 11 dispute settlement mechanism . Including : the NAFTA contracting parties to the attitude of the mechanism and both sides of the point of view of the mechanisms of other international treaties , the mechanisms of international law doctrine of the inspiration of the challenges of national sovereignty and countermeasures .
