Abstract


The study on the principle of good faith is a very import and hot in the civil law field, this thesis is from the international commercial contracts and PICC angle analysis and try to study the international commercial contracts characteristics of good faiths principle, the similar and different that discovers to close the law . Thus for the principles of good faiths of PICC applies to have some benefit.The first , the first chapter makes to the good faith principle to say all, to the provision and contents of the good faith on item within PICC .made the analysis, comparing the good faith principle within PICC to in some countries civil law dissimilarity , emphasized the characteristic of PICC that good faith principle have .Then this chapter discussed the good faith principle in the function in PICC, analyzed it’ s rule system of PICC..In the second Chapter 2 , the author studies the general application to the good faith principle in PICC . It discuss the application of good faith principle provision in general provisions as a fundamental idea . then the author study the application of the relation of the good faith principle and other fundamental principles of PICC.In the third Chapter 3 ,the author analyzes the application of good faith principle of PICC in the formation validity performance interpretation in a international commercial contracts and induce various obligation according to the good faith principle. Then it discuss the good faith apply under the condition of a contract’ s invalidity arising form all kinds matter .Then author summary all kinds implied obligation according the good faith principle in the performance of contract and induces the application of the good faith principle on hardship . In the end , it summary the application of goodfaith principle in a contract interpretation.In the fourth Chapter 4, by the relevant case example , the author induces -. presents and analyzes the application of good faith principle in the non-performance and assignment of right> transfer of obligations > assignment of contracts in PICC . In the end , author introduced the innovation of PICC
