Abstract


Along with our country criminal litigation system changes, especially our government signed the civil rights and political rights international convention, the right to issue has caused scholars, practice boundary and the social public attention. To guarantee human rights, some scholars called for as soon as possible in our country to establish criminal right system to a greater degree of protecting human rights, and with the international phase standards. However, silence is one of the possible effect of various complicated problems. Generally speaking, we to the study of the system of the right is still in the initial stage, in-depth theoretical study especially necessary empirical analysis were insufficient to establish this system in our country and the positive and negative effect to silence the legislative model of the system is not enough to probe. This paper review the United States, Britain in recent years in the right system reform practice and some important dispute, combined with our country's "frankly, resist strictly put" judicial practice, this paper discusses some beneficial enlightenment to us.
