Abstract


Discussed from the point of view of international investment law at all levels since the 1980s , the liberalization of international investment trends , and analysis of countermeasures in China will be affected and this trend should be taken in the area of foreign investment legislation . The author believes that for the majority of developing countries represented by China , does not require the establishment of a global multilateral investment system , bilateral , regional , more flexible arrangements to allow developing countries more freely grasp the pace of investment liberalization . From the legislative practice of domestic and foreign policy point of view , China should adhere to the following position . In view of the not yet become the worldwide popularity of the practice , taking into account China's industrial withstand capability and national economic security , our country should not accept the United States as the representative of developed countries in recent national accorded national treatment of foreign investment during the operational phase treatment extended to the point of view of the market access phase \In addition , to explore the issue of national treatment should also clarify the application of the national treatment object , the applicable conditions and reference standard . For investment in measures to reduce and eliminate our basic attitude is in negotiations with foreign countries , to avoid reckless foreign commitments canceled investment measures , in terms of domestic reform , should gradually reduce the use of investment measures , committed to hard investment environment and improvement of the soft environment , not a restrictive investment measures constrained by foreign investors , encouraging investment measures to gradually reduce , equal competition environment for foreign investment to create an interior . Also be integrated response to the contents of the existing foreign investment legislation , the provisions of the corporate form of organization should be stripped to the Company Law , Partnership Enterprise Law \
