Abstract


Freedom of the press is an important symbol of the contemporary democratic politics , it is an indispensable part of the constitutional concept . The independence of the judiciary is a modern country under the rule of law on the judicial power to configure and run the basic requirements , is a manifestation of human politics to civilization and the rule of law . Freedom of the press is a need to implement the citizens ' right to information and freedom of expression ; independence of the judiciary is to implement the needs of citizens to a fair trial . The right to information and freedom of expression is the fundamental rights of the citizens enshrined in the constitution ; fundamental rights to a fair trial is granted by the Constitution to citizens . The essence of the relationship between the two is the relationship between the two kinds of civil rights fully protected and effective implementation . Freedom of the press and independence of the judiciary relationship is an important part of the rule of law . In our country, the Constitution , Article 35 and Article 4l , 126 , respectively, established the principle of the freedom of the press and independence of the judiciary . But how reasonable to build a relationship between the freedom of the press and independence of the judiciary , the lack of clear legal rules , the conflict between the two in practice have occurred , to become a major problem in today 's building a country ruled by law . This paper , based on the rule of law philosophy visits to explore the freedom of the press and independence of the judiciary value the pursuit of consistency and conflicts while combing through the Western countries to regulate the legal practice of freedom of the press and independence of the judiciary relationship , summed refining norms of freedom of the press and judicial the general principles of the independent relationship .
