Abstract


Parallel import of trademark products does good at national economy as well as doesharm to it with other factors. It is a crucial point of this research to how to go after profit andavoid disadvantage for our country. The trademark product parallel import question alreadypassed through in the western nation more than 100 years discussion, but only then just startedregarding this in our country question research. With the deepening of the reform and opening uppolicy of our country, the successful accession to the WTO, cases involved with parallel importof trademark products have been increasing. This research is of vital importance not only fortheory, but also for practice.Particularly , the article first part is to the parallel import legal analysis. After theintroduction parallel import legal concept, has analyzed the parallel import production reasonand the law manifestation.The second part is to the trademark parallel import legal analysis. After the introductiontrademark parallel import concept and the analysis trademark parallel import legal circumstances,the key point is the feasible analysis which exhausts to the trademark right.The third part mainly elaborates each developed country treatment trademark parallelimport legal policy, and using game theory method analysis trademark parallel import existenceinevitability.The fourth part is this article key point. Elaborates after the summary, proposed our countrythe legal matter, the rules and regulations principle and our country enterprise which should payattention facing the trademark parallel import treat the legal countermeasure which the trademarkparallel import should adopt.
