Abstract


Inflation of the executive power and rise of the positive administrative, make the citizen's basic rights by the threats, the administrative reconsideration system was established in all the countries in the world to adapt to the need and development. In China, administrative management of public security organs wide wide right, whenever and wherever possible violation of citizen's rights and controversial may. The public security administrative reconsideration is an effective way to resolve administrative dispute. Analysis of the current situation of the public security administrative reconsideration of our country, the public security administrative reconsideration system development and improvement of thinking, of great significance. The system of administrative reconsideration of public security of our country basically produce with the public security administrative management, has a far-reaching influence on the public security administrative behavior. But after the test of practice, the public security administrative reconsideration system existing defects, can not be better to play the functions of reconsideration, conscientiously sum up the analysis of this system, and reconstructing the system of judicature on it has become an urgent problem to be solved in front of us. This paper is divided into four chapters, about 4 words. The first chapter briefly introduces the basic situation of the public security administrative reconsideration, including history, the public security administrative reconsideration legislation, legal characteristics of public security administrative reconsideration, administrative reconsideration of the basic content, the second chapter introduces the present situation of administrative reconsideration system security and problems, summed up the current situation of public security administrative reconsideration, the administrative reconsideration the work of the national public security organs and the Public Security Bureau of Ji'nan city actual situation, analyzes the defect of the public security administrative review problems in practice and on the system, the third chapter analyzes the trends of the reform and development of the public security administrative reconsideration of justice, starting from the reform of public security administrative reconsideration positioning, emphasizing the judicature to an efficient, referring to the introduction of procedural justice in theory, provides a solid theory foundation for the reform and development of public security administrative reconsideration of justice. Combined with the system in China's current judicial reform discusses, analyzes the factors of restricting judicial reform. The fourth chapter is the focus of this article, the author puts forward a number of administrative reconsideration of China's public security may move, one is to strengthen the public security administrative reconsideration organization and staffing, two is to establish, improve and avoid hearing system, introduced the hearing system procedure, content, and has strong practical significance, the three is to solve the reconsideration disadvantages of unstopping executive principle brings, four is from the practice and puts forward measures for improvement and perfect the public security administrative reconsideration system.
