Abstract


Arbitration as a voluntary choice by the parties dispute settlement, compared with litigation, party autonomy, more flexible procedures, the speed of time, characteristics of judicial appropriate support. With the international economic exchanges become more frequent, the International Commercial Arbitration System as a common way to resolve international trade disputes in recent years in the international community widely recognized and made considerable progress. Judicial review of arbitration, arbitration and court relations is an important topic to a more practical value is both theoretical significance. The development of international commercial arbitration without court review on the one hand, but on the other hand, the Court's excessive intervention and control, will impede or even stifle the development of arbitration. International Commercial Arbitration Court modest review. This article briefly describes the connotation of the International Commercial Arbitration, International Commercial Arbitration judicial review of the nature and characteristics, discusses the theoretical basis of the mode of operation of the International Commercial Arbitration judicial review. On this basis, the analysis of the problems in the judicial review of China's International Commercial Arbitration, and put forward a number of suggestions and ideas for Improvement of International Commercial Arbitration judicial review. The text is divided into four parts. Chapter I - Introduction. In this section, the author discusses the concept of the International Commercial Arbitration, the characteristics and nature of paper defined the connotation of the International Commercial Arbitration, interpretation of our legislation specific foreign arbitration, the nature of judicial review and the International Commercial Arbitration characteristics are discussed, and lay the foundation for the discussion below. Chapter II - International Commercial Arbitration, the theoretical basis of the judicial review. In this section, respectively, discussed the inevitability of the courts to review arbitration over judicial review, a moderate judicial review and our theories about the mode of judicial review of a foreign arbitration disputes of claims. Chapter III - International Commercial Arbitration, the mode of operation of the judicial review. In this section, respectively, discussed the allocation of the right to judicial review of the International Commercial Arbitration, the scope of judicial review and the way the results and effectiveness of the judicial review. Chapter IV - International Commercial Arbitration Judicial Review. In this section, respectively exposition of the law on international commercial arbitration judicial review, judicial review of the practice of international commercial arbitration overview of the flaws and shortcomings of the judicial review of China's International Commercial Arbitration, and put forward to improve our international commercial arbitration judicial review of a number of suggestions and ideas.
