Abstract


As the effective trade protection measures under the WTO system, anti-dumping has been applied around the world for over 200 years. Since the 1980s, with the global economy development, and the gradual reduction of tariffs by WTO member, antidumping measures will be more and more used by developed and developing countries to protect domestic industries and enterprises, which are intensified international anti-dumping. In 1990s, developing countries have replaced the developed countries and initiated anti-dumping investigations to China. Besides, as the representations of the developing countries, India, Argentina, Brazil, and Mexico always have something to do with randomness and transparency in dealing with anti-dumping cases. So frequently making anti-dumping charges to China has seriously affected the normal development of China’s foreign trade, even affected our good trade relations with the developing countries, which had established for a long term. Since the 2008 international financial crisis, the world economic slowdown, in order to protect domestic industries from the impact of foreign products, countries have adopted anti-dumping measures and other trade protection measures which brought the resurgence of trade protectionism. The world faced a more intense wave of anti-dumping. China as the biggest victim of the anti-dumping investigations should examine the new international economic situation combined with the characteristics of current international anti-dumping, and study the countermeasures, besides improve the trade environment so that keeping a rapid, sustained and healthy economic development.Domestic and foreign scholars have made very profound theoretical analysis on the dumping and anti-dumping. But so far, most domestic existing research studies in trade frictions between developed countries, the theoretical study of anti-dumping between China and developing countries still not deep enough. However, for developing countries and China have similar economic structures and resource endowments, they have maintained good relationship in economic development, and intense anti-dumping measures would seriously affect China’s export and trade development between developing countries. Therefore, under the background of more and more developing countries take anti-dumping against China, the anti-dumping theoretical research in developing countries has been very positive.This paper mainly consists of the status, characteristics, effects, cause and related countermeasures of the anti-dumping activities against China by the developing countries. To this end, through the comparison of the developed and developing countries’anti-dumping behaviors and listing examples of typical developing countries which take anti-dumping measures against China, the article summed up the new situation of developing countries’anti-dumping characteristics, then, studied its effects and causes and ultimately put forward three perspectives of anti-dumping strategy from the government, industry associations and enterprises.In addition, from a legal perspective, the paper expounds the meaning of dumping and anti-dumping, and demonstrates the relevant legal provisions on the basis of current WTO system and the shortcomings of the agreement, such as "non-market economy country" and other discriminatory treatment, the article also pointed out the law systems of the developing countries are commonly not perfect. However, because of my ability and limited data, in this paper some aspects of anti-dumping on developing countries are lack of specific data, analysis of some of the issues involved do not quite right. The effectiveness of specific measures which are used to response to developing countries’anti-dumping should be tested in practice.
