Abstract


This thesis discusses commences from the basic contents define of the invalid marriage system, in understanding the foundation of the invalid marriage system general situation, fixed position in our country marriage method realm, this thesis has a foothold to explain the current marriage method and the related judicatory of provision with apply. The thesis made reference to the marriage lawmaking style of some nations and regions nowadays, analyzing the shortcomings of our invalid marriage system, putting forward some ideas and suggestions in the hope of helping the further development of the invalid marriage system of our country.The thesis consists of four parts: the lawmaking mode of invalid marriage system, the reasons of invalid marriage, the effect of invalid marriage, and the procedures of invalid marriage.Based upon the meanings of invalid marriage and annullable marriage, Chapter one introduces the lawmaking mode of the invalid marriage system. There are two kinds of lawmaking modes, namely the one system and the double track system. Introducing the lawmaking mode of invalid marriage system in all countries, this thesis makes the comparison and evaluation between the two modes. Then it analyzes the invalid lawmaking mode of the marriage system of our country, affirming our double track system is a right choice, bodying that the idea of laying equal stress on sanctions and protection of marriage method, is the current of the world invalid marriage lawmaking nowadays; it puts forward the existent blemish of the lawmaking mode of the double track system in the meantime.Chapter two makes reference to lawmaking example of the invalid
