Abstract


Quasi-contract rooted in the roman law,and was inherited by the civil law and the common law,but there are many differents in the quasi-contract between the civil law and the case law.This paper will research these issues,and compare the quasi-contract from theory and practice between the two legal system.In this article,the differents of conception,legal help , construction and so on,will be analysed.In the meantime,I conclude some thoughts of the law,point out that we should learn something from it.In addition,when we are settling the civil law code,this paper also analyse the voluntary service and unjust enrichment. Finally, I propose some legal advices.
