Abstract


The public utility have the particular character, it is an especial and monopolistic industry. and close to the people’s life. the construction of the public utility is the basic of the municipal construction, is the important part of the economic construction of our country. The level of construction also is an symbol of the level of urban economic development. In recent years, to resolving the problem of government shortage of fund on the construction of public utility and government monopolistic management, the manner of private investment into public utility has took on. However, the lacking of legal norm on it is a serious problem which we should face. This thesis is to explore the administrative legislation on the private investment into the public utility.The thesis is divided into four chapters. The first chapter is a general description of private investment into the public utility. Making the realm of this thesis, introducing the backdrop of appearance and achievement obtained of the private investment into the public utility in our country. The second chapter is the analysis of the problem and the lacking of legal system on the private investment into the public utility from the angle of the practice and the legal thought and legal norm. the third chapter is the comparative administrative legislation overseas on the private investment into the public utility and the enlightenment for our country. introducing the mode of private investment into the public utility overseas and suggesting using the advanced legislative experience for reference. the forth chapter is material countermeasure of administrative legislation. It is the primary part of this thesis. Dissertating form the angle of the principle of legislation and the administrative legislative countermeasure and the proposal of relevant legislation.
