Abstract


May 1, 2004 implementation of the \However , the compulsory third party liability insurance system is still lagging behind in the development of our country , the real establishment of the system also requires a process , especially under the compulsory insurance system , how to effectively and timely relief to the victims of traffic accidents has become the center of gravity of the motor vehicle third party liability insurance concerns . In this paper, through compulsory insurance of motor third party liability , and learn from foreign legislation and related regulations , our ongoing motor vehicle third party liability compulsory insurance legislation put forward some suggestions . The paper is divided into three parts , an introduction, body and conclusion text is divided into five chapters : Chapter Overview of motor vehicle third party liability insurance . The author of a detailed analysis of the concept of liability insurance , the characteristics and the nature of the compulsory third party liability insurance , compulsory third party liability insurance is a social insurance nature of the statutory insurance system , and our motor vehicle first party liability compulsory insurance development is briefly reviewed . Chapter II for compulsory third party liability insurance contract . The main qualifications involving compulsory third party liability insurance contracts , the formation of the contract , insurance coverage , limits of liability , exclusions , I discussed . The third chapter is the responsibility for payment of the insurance company . The author analyzes the traffic damages Liability policy changes , discussed in detail based on the principle of compensation from insurance companies and whether to enjoy the right of defense . In addition , items and standards of the insurance company 's compensation insurance company advances the responsibility and right of recourse discussed . Chapter claims for third party direct . I first introduced the concept , types and legal basis for the claims of third person , then on China Compulsory liability insurance , whether the third person is entitled to the right to direct requests for analysis is proposed to better protect the interests of the injured third person , necessary to give the third party claims directly . Chapter recommendations for the Improvement of motor vehicle third party liability compulsory insurance system .
