Abstract


Organized crimes have disappeared in China mainland , but in recent years the resurgence , and throughout the country at an alarming speed development, the spread of a serious threat to people's lives and property safety , serious damage to the economy and social order . The amendments to the Criminal Code in 1997, the creation of the organization , leadership , participate in the syndicate crime after the Supreme People's Court , the Standing Committee of the National People's Congress made ??the judicial, legislative interpretation , providing a legal basis to effectively combat the crime of the Mafia . However , as the situation develops , the criminal syndicate some new feature or trend , brought new confusion and problems to the legislative and judicial . Starting from the rich theoretical and practical point of easy organizing, leading , to participate in the crime syndicate status quo and development trends , legislative evolution , constitute the characteristics summarized confusing the boundaries of judicial practice , made ??recommendations to improve the legislative and the judicial process , and prevention and control measures to strengthen social . The paper is divided into five parts . The first part of the analysis of the origin , status quo and development trend of syndicate crime in China . The second part describes the organization , leading or participating in the crime syndicate of Legislative History . The third part of the analysis of the organization , leading or participating in the basic characteristics of the crime syndicate . Part IV discusses the recognized organization , leadership , participate in the crime syndicate should note the difference a few boundaries . The fifth section discusses the perfect Mafia Organized Crime Control Strategies .
