Abstract


January 7, 2009, approved by the State Council, Ministry of Industry and Information Technology confirmed that three operators-China Mobile, China Telecom and China Unicom were granted to provide the third generation mobile communication (3G) service domestically. The three licenses issued were TD-SCDMA, CDMA2000 and WCDMA respectively. 2009 is the first 3G year in China. This not only marks China’s formal entry into the era of the third generation mobile communication, but also indicates a new development opportunity for mobile publishing. Mobile phone users can do many things that can be done only on the computer before, such as browse website, download movies, watch television and carry on video chat etc. With the mobile phone gradually becoming a kind of reading terminal for the public to get access to information, mobile publishing will become a brand new pattern after the emergence of web publishing. When 3G technology gradually gains its maturity, the mobile publishing seems to be an affair that happens without extra effort. But rise to a higher degree of system and legitimacy, it also brings some new problems for the publishing management system of China. As an extension of web publishing, the advantages of mobile publishing such as: simplicity, high-speed, low-cost duplication and its technical bottlenecks will inevitably impact on the rational use of it, and thus display an infringement of the copyright holders. Aimed at the disorder state of mobile publishing currently, this thesis will cut in from the perspectives of jurisprudence and communication and analyze the ways of copyright protection in mobile publishing from there factors: the fair use of copyright; collective management and dissemination technologies. Meanwhile, it also puts forward some constructive programs on how to standardize the operation of mobile publishing from two aspects of autonomy and heteronomy.
