Abstract


ruling the country by the law has become the fundamental principals of the Chinese government , accordingly, law-based administration is where its core, focus and the difficulty lies. Compared to the traditional means of mandatory administration ,the administrative guidance stresses that the administrative body should use a non-mandatory administrative guidance to guide the administrative counterpart to take or not take certain actions in order to achieve established goals. As for the administrative counterpart , it is harmonious and easy to accept the administrative guidance for it is lack of unilateral enforce obligations . Administrative guidance is the Chinese government’s basic policy tools, whose success mainly lies in ruling by the law .The author analyses the basis of administrative guidance system, compares the system of administrative guidance in China and other countries , illustrate the importance of the administrative guidance system, reveals the problems exiting in the administrative guiding system in our country , targets at manners and suggestions to achieve administrative guidance by the law , proposes a recommendations for the healthy practice of administrative guidance .
