Abstract


Economic Law is one of the important results of the market Economy Legal system’s development in the 20th. China’Economic Law become more and more perfect with the develop of the China’s Market Economy. But Economic Law is a new subject,The attempt to utilize a traditional method directly in establishing a perfect economic is in vain. The concept, the system of Economic Law depends on the China’s situation, China’s basic national conditions, and so on. And this is the main research idea of Theory of Local Resources. This article is trying to put the Theory of Local Resources into the research of Economic Law.This article studied the generation, development and the concept of the Theory of Local Resources, summarized the features of the Theory of Local Resources, and elaborated the function of the Theory of Local Resources to the research of law.This article defined the Local Resources of Economic Law, so the main points of this article focus on the content of the Local Resources of Economic Law.Many scholars object the Local Resources of Economic Law on the excuse that the China’s traditional culture does not meet the modern market economy, the traditional culture can not provide any reference to the development of Economic Law, and the Local Resources of Economic Law rejection of foreign culture. Some other scholars have a mistake of Local Resources Economic Law, and they exaggerate the range of it. This article criticized those wrong points of view.Local Resources of Economic Law includes three aspects: the resources of traditional cultural, the negative impact of economic development, and the government’s position in economic development. The above content is the emphasis of this article. I will explain it exhaustive in this article. Globalization is an excuse of the opponent to denounce the Local Resources of Economic Law. So this article elaborates the influence of Economic Globalization, Politics Globalization, and Culture Globalization to China Economic Law. This article gives a surefire explanation to the Local Resources of Economic Law in the issue of Globalization.The china construction of China’s Economic Law will be a long-term process. The Local Resources of Economic Law will play a good role in this process.
