Abstract


Financial constitutionalism doctrine is a kind of all financial behaviors about that property relation ideas and principles, relating to taxes , property collects and the final account waited by the government in advance between the country and the people on the public law. But in recent years, our country marketing economy is promptly developing, supporting development about financial legal systems lags relatively with that. The government also realizes that the present available financial systems have already arrived at being not the condition switching over to forbidden, but how reforming ability makes the person accord with the marketing economy inherent law request is a big problem . Already comparatively, the western countries research in the field of financial constitutionalism doctrine that goes deep into and perfects, but our country is in the starting phase. Probe our country constitutional government and the public property road of development, it is a good choice out of doubt on the basis using the western countries research results for reference. The main body of this aritcle is about trying to start private ownership of property and discussing the constitutional government and public property. In this article the writer thinks that ownership of property is a basic right ,the source of public authority , and the emergence of public authority is to protect private interests right. Therefore, the study on the constitutional government and public property should start from personal estate. It is the researching starting point on how to connect the constitutional government with public finiance and how to interact each other. The study on representative system is the key purpose in the article in order to explain the reality of constitutional government and public finiance.In the article the writer explains the relation of representative system, constitutional government and public finiance, then makes the following conclusion:Private ownership of property , the representative system , the constitutional government and public property are in a entire system; Under the marketing economy condition, the fundamental spirit of constitutional government decided the range of the public financial authority and function , public financial behavior effects the construction and development of constitutional government; The constitutional government and public finanial interact and promote mutually in the developing process.
