Abstract


The real estate industry is the pillar industry of China 's economy one of the two production factors affecting the real estate development , land and capital . A large amount of capital investment is necessary to support the continued operation of the real estate industry health , China 's real estate enterprises are facing financing channels for a single , financing regulation in place , the risk of bank funds concentrate ; society at large idle funds are also facing the investment project products to choose from less , the return on investment instability . Therefore, in the case of the current real estate market and banking are highly dependent national retrenchment , the broader financing platform for the development of the real estate market , while also effectively protect the interests of investors system supervision yet to be developed . Real estate investment trusts (REITs) as an innovative securities products can largely solve the financing problems faced by the Chinese real estate industry . In this article, the first two parts proceed from the basic concept of REITs analysis to compare their national history traceability and development status , comprehensive comparison of the pros and cons of REITs typical operating mode ; Part III for the feasibility of the introduction and implementation of REITs and necessity , as well as REITs facing legal difficulties in the development of our country , trying to analysis of how to create the most suitable for the local soil for REITs ; part IV departure from the legal system and the design of specific systems , how to choose the screening REITs run mode develop industry Investment Fund Act and the establishment of a special chapter in regulation REITs legislation envisaged under the premise . This paper attempts to start from a comparative analysis the countries REITs system design and the development of the legal environment , to take full account of the relevant factors of the real estate industry , the financial markets , legal environment , policy background basis , the proposed development of REITs in China should follow the Simple easy , step-by-step ideas , we must first set up the \legal environment and legal support .
