Abstract

Official property is the important part of Administrative organization law, is the indispensable material means for administrative body during administrate and finish the administration purpose. Official property should be use for the public interest, As for the use of official property is regarded as the administrative affairs, not have external relations, only few scholars show the concern on it or do depth research. That causes the lack of the theory, imperfect of law. The powers of administrative subject can’t be controlled effectively, that causes lots of official property for personal use and had a bad influence. It is bad for controlling the private use of official property. This paper begins form the concept of official property, explains the meaning of official property for personal use, then analyses the causes for the problem, and last puts forward some basic solutions in law. The purpose of this paper is improved the related legal system, played the real effect of supervision, controlled the power to use official property, and reduced the phenomenon of official property for personal use.This paper includes three parts:The first chapter is the problem introduction. This chapter defines official property through comparing and analyzing the existing concept at home and abroad, explains the meaning of official property for personal use, points the necessity of this problem. At last, points the academic interest and practical significant on our research.The second chapter is about the causes of personal use of official property. The causes of personal use of official property is complicated, this chapter is mainly based on the administrative subject, we analysis of the causes of personal use of official property in detail, are lacking in legal institution and supervision on the power to use official property. The shortage in investigating the responsibility of illegal administrative subjects and unclear understanding of administrative subjects in their power and responsibility are also the causes.In the last chapter puts forward some basic solutions in law. This chapter is mainly from the perspective of supervising administrative legal relationship, puts forward some basic solutions in the subject, object and content of supervising administrative legal relationship.
